Terms of service

Last updated October 22, 2026

These terms are the agreement between TeeMarshal, Inc. ("TeeMarshal", "we", "us") and the golf course, operator, or organization that signs up for the service ("you", "the course"). The short version: you pay a flat monthly price, there is no long-term contract, your golfer data belongs to you, and you can export it and leave at any time.

1. The service

TeeMarshal provides web-based software for golf courses: a tee sheet, an online booking engine, payment processing through Stripe, a golfer database, email and text messaging, reporting, importers, a public API, and the optional modules included in your plan (together, the "service"). Features marked as rolling out, beta, or labs may change or be withdrawn and are provided as is.

By creating an account, clicking to accept, or using the service, you agree to these terms on behalf of the business you represent and confirm that you have authority to do so.

2. Your account and your staff

  • You are responsible for the people you invite to your account and for what they do in it.
  • Keep login methods and API keys secure. Tell us promptly at security@teemarshal.com if you suspect unauthorized access.
  • Give us accurate business information. Some features (Stripe payouts, text message registration) require verified business details such as your legal name, address, and EIN.
  • You must be a business, not a consumer, to use the service.

3. Plans, fees, and billing

  • Flat subscription. You pay the monthly price for your plan as shown on our pricing page or your order. We do not take barter tee times and we do not charge a per-booking fee.
  • Text message allowance. Each plan includes a monthly allowance of text messages per course. Messages above the allowance are billed in arrears at our carrier cost plus a small handling margin, as stated on the pricing page.
  • Payment processing. Card payments from golfers are processed by Stripe on your own Stripe connected account. You pay Stripe's processing fees directly to Stripe. If TeeMarshal ever adds a platform fee to payment processing, we will give you at least 30 days written notice before it applies to you.
  • Billing. Subscriptions are billed monthly in advance to the payment method on file. Fees are in US dollars and do not include taxes, which we add where required.
  • Price changes. We may change prices with at least 60 days notice. Courses on the founding-course offer keep their locked price for as long as their subscription stays active without a lapse, as described in the offer terms.
  • Late payment. If a payment fails we will retry and notify you. After 7 days past due we may show a billing banner in the app. After 21 days past due we may make the tee sheet read-only. We will not block check-in of existing bookings because of a billing problem.

4. No long-term contract. Cancel any time.

The service is month to month unless you and we sign a separate order that says otherwise. You can cancel from the billing settings in the app. Cancellation takes effect at the end of the current billing month, and we do not refund partial months unless the law requires it or we terminated without cause.

We may suspend or terminate your account if you materially breach these terms and do not fix the problem within 15 days of notice, if you break the acceptable use policy in a way that puts other customers, golfers, or our providers at risk, or if we are required to by law. We may stop offering the service altogether with at least 90 days notice and a prorated refund of any prepaid fees.

5. Your data

  • You own it. Your golfer records, bookings, rates, messages, and reports ("course data") belong to you. We claim no ownership of course data.
  • What we do with it. We use course data to provide, secure, and support the service for you, as described in the data processing addendum, which is part of these terms. We do not sell course data. We do not market to your golfers. We do not run a consumer marketplace that competes for your golfers.
  • Export. You can export all course data as CSV files from settings at any time, and read it through the public API, at no extra charge.
  • After you leave. Your data stays available for export for 30 days after cancellation. After that we delete or anonymize it within a further 60 days, except records we must keep by law (for example financial records) and data in backups, which age out on our normal schedule.
  • Aggregate data. We may use statistics that do not identify you, your course, or any golfer (for example overall system performance) to run and improve the service.

6. Your responsibilities to golfers

  • You are the seller of tee times, merchandise, memberships, gift cards, and anything else sold through the service. You set prices and policies and you are responsible for honoring them, for refunds, and for taxes on your sales.
  • You are the sender of messages sent from your account. You must have the consent the law requires before sending marketing email or texts, and you must honor opt-outs. The service provides tools for this (consent capture, STOP handling, quiet hours, unsubscribe links) but the legal responsibility is yours. See the SMS terms.
  • If you import golfer contacts and mark them as having consented to marketing, you are attesting that the consent exists and that you can show it if asked.
  • You are responsible for having a privacy notice for your golfers that covers your use of the service.
  • If you turn on call recording for the phone agent, you are responsible for meeting the notice and consent rules in your state.

7. Payments through Stripe

Payment processing is provided by Stripe and is subject to the Stripe Connected Account Agreement, which includes the Stripe Services Agreement. By connecting a Stripe account you agree to those terms. You are the merchant of record. Funds go from the golfer to your Stripe account and are paid out by Stripe to your bank. TeeMarshal does not hold your funds. Chargebacks, disputes, and refunds are your responsibility, and we provide booking records to help you respond to them.

8. AI features

Some features use AI models, including the phone agent, marketing drafts, and written monthly reports. AI output can be wrong. The phone agent is built so that prices and availability come only from your tee sheet, and marketing drafts are suggestions that a person at your course approves before they send. You are responsible for reviewing suggested content and for the settings you choose. We do not allow our AI providers to train their models on course data.

9. Third-party services

The service connects to third parties you choose to use, such as Google (analytics, Reserve with Google), marketplaces, and anything you connect through the API or webhooks. Those services are governed by their own terms, and we are not responsible for them. Our own infrastructure providers are listed on the subprocessors page.

10. Availability and support

We work to keep the service available around the clock and publish incidents and maintenance on our status page. We do not promise that the service will be uninterrupted or error free. Support is available by email at support@teemarshal.com. Any specific uptime or response-time commitment applies only if it is written in a signed order.

11. Our intellectual property

We own the service, including the software, design, and documentation. We grant you a non-exclusive, non-transferable right to use it for your business while your subscription is active. If you send us feedback, we may use it without obligation to you.

12. Confidentiality

Each side will protect the other's non-public information with reasonable care and use it only to carry out this agreement. This does not cover information that is public, already known, independently developed, or required to be disclosed by law.

13. Warranties and disclaimers

We will provide the service with reasonable skill and care. Beyond that, the service is provided as is and as available. To the extent the law allows, we disclaim all other warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee any level of bookings, revenue, or savings. Calculators and examples on our site are estimates.

14. Limitation of liability

To the extent the law allows, neither side is liable to the other for lost profits, lost revenue, or indirect, special, incidental, or consequential damages. Each side's total liability under this agreement is limited to the fees you paid us in the 12 months before the event that caused the claim. These limits do not apply to your obligation to pay fees, to either side's indemnity obligations below, or to liability that cannot be limited by law.

15. Indemnity

We will defend you against a third-party claim that the service, used as these terms allow, infringes that party's intellectual property rights, and pay the resulting damages and costs awarded. You will defend us against third-party claims arising from your course data, your messages to golfers, your sales to golfers, or your breach of the acceptable use policy, and pay the resulting damages and costs awarded. The side asking for a defense must give prompt notice, reasonable cooperation, and control of the defense.

16. Changes to these terms

We may update these terms. For changes that materially reduce your rights we will give at least 30 days notice by email or in the app. If you do not agree, you can cancel before the change takes effect. Continuing to use the service after that date means you accept the updated terms.

17. General

  • Governing law. These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Courts located in Delaware have exclusive jurisdiction, except that either side may seek injunctive relief anywhere.
  • Assignment. Neither side may assign this agreement without the other's consent, except to a successor in a merger or sale of substantially all of its business.
  • Force majeure. Neither side is liable for delay or failure caused by events beyond its reasonable control.
  • Entire agreement. These terms, the data processing addendum, the acceptable use policy, the SMS terms, and any signed order are the whole agreement. If they conflict, a signed order controls.
  • Severability. If part of these terms is unenforceable, the rest stays in effect.
  • Notices. We send notices to the owner email on your account. Send legal notices to us at legal@teemarshal.com.
